1. L’Oréal Australia Pty Ltd (L’Oréal) will honour a money back guarantee (Guarantee) in accordance with these Terms and Conditions.

2. Information on how to claim forms part of these Terms and Conditions. By making a claim, claimants agree to be bound by these Terms and Conditions. Claims must comply with these Terms and Conditions to be valid. Offer not valid in conjunction with any other offer.

3. The Guarantee applies to retail purchases in Australia of L’Oreal Paris Magic Retouch Root Touch Up Concealer Spray (Product) purchased between 26th of June – 9th of August 2020 (Purchase Period). All 9 shades of the Magic Retouch Spray range are considered an eligible Product for the purposes of this Guarantee.


Eligible Entrants

4.The Guarantee is open to Australian residents only.

5.Claimants under 18 years old must have parental/guardian approval to claim and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by L’Oréal to enter into a further agreement as evidence of consent to the minor submitting a claim in this Guarantee.

6. Employees and their immediate families of L’Oréal and its agencies (including printers, suppliers and providers) associated with this Guarantee are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

7.L’Oréal (or its nominated third party) reserves the right to verify the validity of claims and claimants (including a claimant’s identity, address and any information from claimants relevant to their claim) and to reject any claim if, in L’Oréal’s reasonable opinion the claim is false, invalid, fraudulent or ineligible. Errors and omissions may be accepted at L’Oréal's discretion. Failure by L’Oréal to enforce any of its rights at any stage does not constitute a waiver of those rights. L’Oréal's legal rights to recover damages or other compensation from such an offender are reserved.

8. Only one (1) claim will be permitted per person per household.

9. Incomplete or indecipherable claims will be deemed invalid.

10. To be eligible for the Guarantee, you must:

  a. purchase the Product from a retailer in Australia, including the authorised online retailers as listed in Annexure A below within the Purchase Period and retain your proof of purchase;

  b. use the Product in accordance with any usage instructions provided with the Product; and

  c. if you are not satisfied with the Product, make a claim in accordance with these Terms and Conditions.

11. Claimants must retain their original purchase receipt(s) for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of L’Oréal, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to a Guarantee. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Purchase Period but prior to claim.


Claiming the Guarantee

12. To claim the Guarantee, you must send an email to [email protected] by no later than 11:59pm AEST on 23rd of August 2020 and include:

  a. your personal details including name, contact number, valid email address and postal address;

  b. a photograph of the Product;

  c. a photograph of your proof of purchase with all details clearly visible;

  d. an answer to the following questions:

     i. Have you previously used a retouch product? If yes, which one?

     ii. Where did you hear about Magic Retouch Spray?

     iii.What made you purchase Magic Retouch Spray? and

  e. a brief explanation as to why you are not satisfied with the Product.

13. An eligible claimant who submits a valid claim will receive a refund of the price paid by the claimant for the Product, inclusive of GST, up to a maximum of AUD$15.95. The refund will be paid by way of cheque, sent to your nominated postal address. It will be sent by your nominated postal address within seven (7) business days of validation of your claim. Only those entrants who provide all the required information will be eligible for the Guarantee. Claimants should allow up to twenty-eight (28) days for delivery of their refund cheque. The refund cheque can only be delivered to an Australian address.

16. If there is a dispute as to the identity of a claimant, L’Oréal reserves the right, in its sole discretion, to determine the identity of the claimant.

17. L’Oréal’s decision is final and no correspondence will be entered into.

18. If a claimant of the Guarantee is under the age of 18 years, the Guarantee will be awarded to the claimant's nominated parent or guardian on the successful claimant’s behalf.

19. If for any reason a claimant does not redeem a Guarantee by the time stipulated by L’Oréal, then the Guarantee will be forfeited.

20. Guarantees, or any unused portion of a Guarantee, are not transferable or exchangeable.

21. The value of the Guarantee is accurate and based upon the recommended retail value of the Product (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Guarantee after that date.

22. Claimants who use multiple email addresses, residential addresses and/or aliases may be disqualified.

23. If this Guarantee is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of L’Oréal, including but not limited to technical difficulties, unauthorised intervention or fraud, L’Oréal reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the Guarantee, as appropriate.

24. If a Guarantee is provided to the Promoter by a third party, the Guarantee is subject to the terms and conditions of the third party Guarantee supplier and the provision of the Guarantee is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the Guarantee at the time it is issued to the claimant will prevail over these Terms and Conditions, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the Guarantee, any delay or receive their claim or failure relating to the Guarantee itself or failure by the third party to meet any of its obligations in these Terms and Conditions or otherwise

25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, L’Oréal (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Guarantee.

26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, L’Oréal (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under L’Oréal’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by L’Oréal) due to any reason beyond the reasonable control of L’Oréal; (d) any variation in Guarantee value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the Guarantee.


Privacy Notice

27. Our privacy policy (which can be found at (Privacy Policy) applies in relation to the collection, storage and use of your personal information. By claiming the Guarantee, you agree to our Privacy Policy. L’Oréal collects personal information ("PI") in order to conduct the Guarantee and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. L’Oréal will also use and handle PI as set out in its Privacy Policy, which can be viewed at In addition to any use that may be outlined in L’Oréal’s Privacy Policy, L’Oréal may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of L’Oréal. Unless otherwise indicated by L’Oréal, L’Oréal may disclose personal information to entities outside of Australia (for a list of the countries, see L’Oréal’s Privacy Policy).
